ORDER: The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 329(4) BNS 2023 r/w 4 of TNPHW Act, 1998, in Crime No.247 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had trespassed into the house of the defacto complainant and pulled her dress. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that there was a property dispute, a false case has been given. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent submitted that there are four previous cases pending against the petitioner in which one case under POCSO. He further submitted that the 2/4

investigation has been completed and the charge sheet has also been filed. Hence, he opposed for grant of anticipatory bail to the petitioner. 5.The present petition is 2nd anticipatory bail application and there is no change in circumstances. The petitioner is an alcoholic and repeatedly commits offences under the influence of alcohol. Considering the facts and circumstances of the case, this Court directs the petitioner to surrender before the trial Court. Upon such surrender, the learned trial Judge shall independently consider the matter in accordance with law.

6.With the above said directions, the Criminal Original Petition is disposed of.
