O R D E R

This Writ Petition is filed challenging the impugned refusal Check Slip issued by the 2nd respondent in Refusal Number RFL/Kadayanallur /28/2025 dated 11.06.2025 and also seeking for a consequential direction, directing the 2nd respondent to register the petitioner's settlement deed dated 09.06.2025 in accordance with law within a stipulated period as framed by this Court.

2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

The grievance of the petitioner is that when the petitioner presented a settlement deed for registration, the same was refused to be registered on the ground that the patta in respect of the subject property stands in the name of difference persons. Challenging the same, the petitioner has filed this Writ Petition.

4. The learned counsel appearing for the petitioner would submit that the error committed in the settlement register has been rectified in the Town Survey Land Register. He further submits that without verifying the said fact, the 2nd respondent simply issued the impugned refusal check slip. Therefore, the impugned refusal check slip issued by the 2nd respondent is liable to be set aside.

The learned Additional Government Pleader appearing for the respondents would submit that since the error committed in the settlement register has been rectified in the TSLR, the second respondent will register the settlement deed presented by the petitioner within the time limit prescribed by this Court.

6. This Court heard the submissions made by the learned counsel appearing on either side and perused the materials available on record.

7. On a perusal of the records, it is seen that the error committed in the settlement register has been rectified in the Town Survey Land Register. However, without verifying the said fact, the 2nd 3/6

respondent has passed the impugned refusal check slip. Therefore, the impugned order is liable to be quashed.

7. Accordingly, the impugned refusal check slip issued by the 2nd respondent is set aside. The 2nd respondent is directed to register the settlement deed dated 09.06.2025, with regard to the settlement of petitioner's 1/4th share based on the TSLR, as the error committed in the settlement Register has been rectified in the TSLR.

8. With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
