PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the first respondent to consider the petitioner's representation dated 04.02.2020, within a time frame fixed by this Court. For Petitioner :

The Writ Petition is filed to direct the first respondent to consider the petitioner's representation dated 04.02.2020

2. By consent of both parties, the Writ Petition is taken up for final hearing at the stage of admission itself.

3. The case of the petitioner is that on 14.02.2019, he met with an accident and for taking treatment, he availed medical leave for the period from 15.02.2019 to 14.03.2019 and 15.03.2019 to 11.04.2019, with proper medical certificates. But the second respondent has not forwarded his salary proposal to the treasury for the month of February, March and April 2019, stating that the petitioner has not paid the Income Tax returns. After several follow ups with the second respondent, the salary proposal of the petitioner has been forwarded to the treasury only on 21.06.2019 and three months salary was credited to the petitioner's account on 27.06.2019. Thereafter, the petitioner has made a representation to the 1st respondent on 04.02.2020, to take appropriate action against the 2nd respondent, for belated payment of salary and to provide https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.4434 of 2020 interest on belated payment. As no action has been taken, the petitioner has come up with this present Writ Petition.

4. Considering the limited scope of the prayer in the Writ Petition, there shall be a direction to the respondents to consider the petitioner's representation dated 04.02.2020 and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. It is needless to state that the petitioner shall enclose a copy of this order along with his representation to the respondents.

5. With the above direction, the Writ Petition is disposed of. No costs.
