Respondents Prayer : Contempt Petition is filed under Section 11 of the Contempt of Courts Act, 1971 to punish the contemnors / respondents herein for their deliberate and willful disobedience of the order of this Court dated 25.04.2024 in Writ Petition (MD)No.3723 of 2024 amounting to Contempt of Court under Article 215 of the Constitution of India read with Section 11 of the Contempt of Courts Act, 1971. ORDER
This contempt petition is filed complaining the wilful disobedience of the the respondents in implementing the order dated 25.04.2024 made in W.P.(MD)No.3723 of 2024 passed by this Court. 2/6
2.While allowing the said writ petition, this Court directed the respondents therein to disburse all the monetary benefits including the arrears of salary from 17.06.2009 onwards till June 2022 within a period of twelve weeks from the date of receipt of copy of that order. 3.The learned counsel for the petitioner submits that since the order of this Court has not complied with within the stipulated time granted by this Court, the petitioner was constrained to file this contempt petition.
4.There is discrepancy with regard to the date of communication of the order of this Court to the respondents. The learned counsel on either side are not coming with correct particulars about the date of service of the order of this Court. However, it is now reported that the respondents implemented the order of this Court and disbursed all the monetary benefits to the petitioner for which she is legitimately entitled vide G.O.(D)No.69, Higher Education (E2) Department dated 01.04.2025. 3/6
5.It appears that admittedly, there is some delay in implementing the order of this Court. Considering the reasons stated in the counter affidavit filed by the respondents, this Court intends to take lenient view towards delay occurred in implementing the order of this Court. 6.For the above stated reasons, this contempt petition is closed. However, the respondents should be cautious and vigilant in implementing the orders of this Court within the time stipulated by this Court in future.
