The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 9(m)(l) Section 10 of the POCSO Act, and Sections 332(c) and 351(2) of BNS, 2023, in Crime No.25 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner trespassed into the house of the defacto complainant when her minor daughter was alone, and alleged to have touched the victim girl and threatened her not to disclose the same. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed such offence. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) produced the 164 statement of the victim minor girl and opposed for grant of anticipatory bail to the petitioner.

5. After perusing the 164 statement this Court is not inclined to grant anticipatory bail to the petitioner. The petitioner has already gave money as loan to the defacto complainant's husband and taking advantage of the same, he acted awkwardly with the victim girl. Hence, this Court is not inclined to grant anticipatory bail. Accordingly, this Criminal Original Petition is dismissed.
