ORDER
This criminal original petition has been filed for a direction to the learned Judicial Magistrate No.IV, Tiruchirappalli to dispose of the case in C.C.No. 294/2018 on his file as expeditiously as possible and within the time stipulated by this Court.
2. According to the petitioner, he is the second accused in this case and FIR is of the year 2018 and the charge sheet was also filed in the year 2018 and the case in CC No.294 of 2018 for the offence under Sections 392 and 414 of IPC, is pending for the past seven years. There is no progress in the trial proceedings. Therefore, the petitioner filed this petition for speedy disposal.
3. The learned Government Advocate appearing for the respondent would submit that the case is pending only because of the non-appearance of the accused. A non bailable warrant was issued for the co-accused and only on appearance of the said accused, the non bailable warrant was cancelled. Now the case is posted for cross examination of PW1, who was already examined. He 2/4
would further submit that the respondent will cooperate for speedy disposal of the case and produce the witnesses as directed by the trial Court.
4. Heard the learned counsel on either side and perused the records placed before this Court.
5. Since the case is pending for the past seven years and also the case is posted for cross examination of witnesses, this Court directs the learned Judicial Magistrate No.IV, Tiruchirappalli, to dispose of the CC No.294 of 2018 as early as possible without giving any long adjournments.
6. With the above direction, this criminal original petition is disposed of. 20.02.2025 Index :
