Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 to 3 to reclassify the land in Survey Nos. 146/1 and 146/2 (Old Survey No.140) totally admeasuring about 26.30 acres situated at T.Kumaragiri Village Group, Ottapidaram Taluk, Thoothukudi District from 'Oorani' to 'Private Temple Punjai Land' and consequently transfer the patta for the said lands in the name of the petitioner Trust.

ORDER

The learned counsel appearing for the writ petitioner states that he is giving up the second part of the prayer. He would file a fresh writ petition regarding the same.

2.With this liberty to the writ petitioner, this writ petition is disposed as not pressed the second part of the prayer.

3.The petitioner seeks reclassification of the petition mentioned survey land. The petitioner has given a representation before the respondents. The second respondent is directed to consider the same and pass final order on merits and in accordance with law within a period of eight weeks from the date 2/4

of receipt of a copy of this order. The second respondent will hear all the interested persons before passing final order. I make it clear that I have not gone into the merits of the matter. It is open to the second respondent to pass order one way or the other.

4.This writ petition is disposed of accordingly. There shall be no order as to costs.
