ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 120B and 420 IPC in Crime No.2 of 2015 on the file of the respondent police, seeks anticipatory bail.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the State.
3. The defacto complainant in this case is the Tahsildar of Paramakudi. As a social welfare measure, the Government of Tamil Nadu is giving old age pension to the poor and needy. This petitioner has obtained applications from one S.K.Sami and Subbu Raman and also obtained sanction orders from the authorities for payment of monthly pension to them. After obtaining the sanction orders, this petitioner, in conspiracy with the local postman, has been enjoying the pension amount every month by not delivering the money order to the beneficiaries. Under this head, the petitioner and the postman have been misappropriating the monthly pension payable to the beneficiaries from 01.08.2012 to 30.09.2014.
4. Similarly, this petitioner and the postman have been misappropriating the monthly pension that was sanctioned to one Backiammal and Indira Gandhi even after their death without reporting the factum of their death to the authorities.
5. Learned counsel for the petitioner submitted that the petitioner is the husband of the local Councillor and therefore, this case has been foisted.
6. The complainant in this case is not any one belonging to a rival political party, but the concerned Tahsildar. Social welfare measures intended for the poor and the needy have been very cleverly misused by this petitioner in collusion with the local postman. https://hcservices.ecourts.gov.in/hcservices/
7. Taking into consideration the serious nature of allegations against this petitioner, this Court is not inclined to grant anticipatory bail to him.
