Prayer : Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, praying to direct the respondents to provide adequate police protection to the petitioner and his property in Survey Nos.127/1 and 128/3 situated at Kalkurichanpatti Village, Vikkiramanagalam Post, Usilampatti Taluk, Madurai District, so as to enable the petitioner to survey and demarcate the above properties with the help of Revenue Official.

O R D E R

The petitioner is said to be owner of the land in Survey Nos.127/1 and 128/3 situated at Kalkurichanpatti Village, Vikkiramanagalam Post, Usilampatti Taluk, Madurai District. Seeking to survey the land, in view of the objection raised by the impleading respondent, the petitioner sought for police protection as it was not considered, the present petition has been filed.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for R1 and R-2 and there is no appearance for R-3.

3. When the matter was taken up for hearing on 07.04.2015, this court directed the petitioner to implead the third respondent. Since the third respondent was impleaded by the order of this court in Miscellaneous Petition.(MD).No.1 of 2015 in Crl.O.P.(MD).No.5053 of 2015, despite the notice having been served to R-3 and his name has been https://hcservices.ecourts.gov.in/hcservices/

printed in the cause list, the said third respondent is not appeared. The learned Government Advocate (Crl. Side) submitted that the revenue records stand in the name of the petitioner.

Considering the said submission and taking note of the fact that the petitioner seeks merely police protection to survey the land, the second respondent is directed to give adequate police protection to survey the land in Survey Nos.127/1 and 128/3 situated at Kalkurichanpatti Village, Vikkiramanagalam Post, Usilampatti Taluk, Madurai District, within a period of two weeks from the date of receipt of a copy of this order.

5. This Criminal Original Petition is disposed of with the above direction.
