ORDER : The Court made the following order :- 1/4

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 318(4), 336(3) and 351(3) of BNS 2023, in Crime No.9 of 2026 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and her husband who is A1 have cheated a huge amount from the defacto complainant. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that A1 was already arrested and he opposed for grant of anticipatory bail to the 2/4

petitioner.

5. The allegation against the petitioner is that she and her husband have received 3,590 grams of gold worth about Rs.4 crores and cheated the defacto complainant. A1 was already arrested. Considering the same, and the seriousness of the offence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
