Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, or any other Writ or Order or Direction in the nature of Writ, directing the respondent to consider the petitioner's representation, dated 28.01.2020 and direct the respondent to issue the deposit amount of Rs.4,50,000/- interest which was deposited by the petitioner and the total amount of Rs.4,50,000/-calculated with 8% in the name and style of V.S.B. Jeyachandran, fifth Class Contractor contract Licence No.Ma.Po.Ma.Po.4/6805/12 in registered No.85 for the public work for the period of 2012 to 2020.

ORDER

The Writ Petition has been filed seeking direction to the respondent to consider the petitioner's representation, dated 28.01.2020 and also for a direction to the respondent to issue the deposited amount of Rs.4,50,000/-interest which was deposited by the petitioner and the total amount of Rs.4,50,000/-calculated with 8% in the name and style of V.S.B. Jeyachandran, fifth Class Contractor contract Licence No.Ma.Po.Ma.Po.4/6805/12 in registered No.85 for the public work for the period from 2012 to 2020.

2. The representation was given by the petitioner on 28.01.2020. Since, no action was taken by the respondent on the said representation, the petitioner has come forward with this Writ of Mandamus, seeking direction against the respondent/Madurai Corporation to pass order on the said representation.

3. The necessity for the petitioner to give a representation and also to file the instant writ petition is that he is a Fifth Class Contractor having been engaged by the Madurai Corporation to execute various works. The details of works are extracted hereunder in the tabular column:

4. The petitioner claims that to his knowledge there are no adverse remarks as regards the scope of the work and that he has completed the works and now claims the security deposit.

5. Mr.R. Murali, learned standing counsel takes notice for the respondent.

6. By considering the main writ petition itself, a direction is issued to the respondent to consider the representation of the petitioner, dated 28.01.2020 and pass orders on or before 03.04.2020.

7. The respondent may also invite the petitioner and have a discussion with him over the works done and thereafter pass an order, on or before 03.04.2020.
