The Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure, to withdraw the proceedings in H.M.O.P.No.34 of 2024 on the file of the Family Court, Krishnagiri and transfer the same to the file of the Family Court, Madurai.

ORDER

When the matter came up for hearing toady, it is reported that the matter is settled before mediation. The following settlement has been arrived between the parties hereto:

a)This agreement arise between husband A.Karthickeyan and wife M.Monisha Nachiar Transfer petition filed by wife before Hon'ble Madras High Court, Madurai Bench to transfer the H.M.O.P.No.34 of 2024 (Restitution of Conjugal rights) before Family Court, Krishnagiri, petition filed by husband praying to transfer to Madurai where C.R.M.P.No.699 of 2024 in D.V.C.No.68/2023 Additional Mahila Judge(Magistrate Level) Madurai. Now the Transfer petition referred to mediation by Hon'ble High Court where both parties agreed to joint live together by following conditions herein:

(i)Husband will come to Madurai to be with wife and child monthly 3 weekends (Saturday and Sunday) for the period of 6 months from the date of Hon'ble Court order. (ii)Husband will give monthly expense of Rs.15,000/- for wife and child (K.Nabhanyu Ayyan) expenses to bank account of the wife Acc.No.11770110022191, IFSC : UCBA0001177 - UCO Bank, K.K.Nagar Branch, Madurai.

(iii)The husband hereby promise to take care of family expenses, expenses to wife and their child (K.Nabhanyu Ayyan) till life.

(iv)The husband hereby promise that he will not interfere or stop the earning of wife for their family. (v)After six months wife will travel to Hosur (or) Krishnagiri to live with husband in a separate house to lead marital life.

(vi)Wife hereby record that total 5 sovereign of gold ie., 1 necklace and 2 sets of earrings and dress and vessels worth about Rs.75,000/- are with husband custody.

(vii)Hereby husband & wife withdraw both the case filed by them. H.M.O.P.No.34 of 2024 filed by husband and pending before the Family Court, Krishnagiri and C.R.M.P.No.699 of 2024 in D.V.C.68 of 2023 Additional Mahila Judge (Magistrate Level) Madurai filed by wife.

(viii)Hereby husband and wife have liberty to file a case if any one of them fail to follow the condition mentioned above." 2.Since the parties have reunited as per the settlement agreement, this Transfer Civil Miscellaneous Petition is disposed of by recording the terms of mediation settlement agreement. No costs. Consequently, connected miscellaneous petition is closed.
