Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the first respondent to pass final orders in the petitioner's arbitration petition No.83/Tmm/Sengulam/2013 for enhancement of compensation against the award passed by the second respondent in Award No.57/2007, Roc No.A2/172/06 (B9/110047/2004) dated 04.05.2007 within a time limit fixed by this Court. For Petitioner : Mr.PT.S.Narendravasan For Respondents : Mr.Aayiram K.Selvakumar, Additional Government Pleader.

ORDER

According to the petitioner, the petitioner's land is acquired for formation of national highways, and an award was also passed on 04.05.2007. Not being satisfied with the award, he filed an arbitration petition under Section 3(G)(5) of the National Highways Act, before the first respondent in the year 2013, and the petition is numbered as A.P.No.83/Tmm/Sengulam/2013. But, so far no order has been passed, hence, the present writ petition has been filed.

2.Considering the facts and circumstances of the case, as the arbitration petition is pending with the first respondent from the year 2013, without going into the merits of the case, the first respondent is directed to consider the arbitration petition filed by the petitioner, and pass suitable orders on merits and in accordance with law, after affording sufficient opportunity to the petitioner, within a period of twelve weeks from the date of receipt of a copy of this order.

3.With the above direction, this writ petition is disposed of. No costs.
