Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 and 2 to take appropriate action against the 5th respondent for running an illegal brick kiln in land in Survey No.64/1, Konnathur Village, Vilavancode Taluk, Kanyakumari District and for illegal extraction of sand and for damaging the bund of Paraliyaaru river situated at Kunnathur Village, Vilavancode Taluk, Kanyakumari District and consequently to restore the said Paraliyaaru river to its original position by considering the representation given by the petitioner dated 03.01.2026. ORDER

Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader for R1 to R4.

2. The petitioner is a resident of Kunnathur Village, Vilavancode. He alleges that the fifth respondent is illegally running the brick kiln in S.No.64/1 and is also illicitly mining sand from the adjacent river (Paraliyaaru). 2/4

3. The learned Special Government Pleader on written instructions states that license given in favour of the fifth respondent expired as early as on 26.09.2022. The Assistant Director of Geology and Mining has written to the Tahsildar, Taluk Level Task Force, Vilavancode Taluk, on 05.02.2026 seeking report in this regard. It is further undertaken that based on the report of the Taluk Level Task Force, action will be taken against the offender and penalty also will be levied and criminal case also will be registered.
