O R D E R
This Criminal Original Petition is filed to transfer the investigation in respect of Crime NO.110 of 2014, on the file of the fourth respondent police to the file of the third respondent.
2. Heard the learned Counsel for the petitioner and the learned Government Advocate (Crl.Side).
3. The petitioner has come forward with this petition seeking transfer on the ground that it has not been proceeded in the right way. The sum and substance of the case of the petitioner is that one Periyakaruppan has not been arrayed as accused.
4. The learned Government Advocate(Crl.Side), based on the status report, submitted that there is absolutely no material against the fourth respondent. He further submitted that totally there are three accused and they were arrested and released on bail and one of them is https://hcservices.ecourts.gov.in/hcservices/
still in judicial custody and the investigation is almost over and the said Periyakaruppan has already been enquired.
5. Considering the above facts and circumstances of the case, this Court is not inclined to transfer the investigation and the fourth respondent is directed to file a final report within a period of three months from the date of receipt of a copy of this order. If the petitioner is aggrieved, it is well open to him, to proceed in accordance with law.
