PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the third respondent herein to complete the enquiry and to pass orders on the petitioner's patta transfer application dated 24.06.2024 in view of the direction of the first respondent in his proceedings in Na.Ka.No.U3558/2024, dated 06.09.2024 within the time stipulated by this Court. ORDER
Considering the limited scope of the relief sought for in the writ petition, with the consent of the learned counsel on either side, the writ petition is taken up for final disposal at the stage of admission itself. 2.Heard the learned counsel on either side.
3.The limited relief that has been sought for in this writ petition is only a direction to the third respondent to complete the enquiry and pass final orders on the petitioner's patta transfer application dated 24.06.2024. 2/5
4.The petitioner, noticing the wrong entries in the revenue records, has made an application to the second respondent, who in turn forwarded the same to the third respondent even as early as in 2021. However, no action has been taken by the third respondent to dispose of the said application, which is pending from December 2021 onwards. The petitioner sent the second application to the respondents 1 and 4 on 24.06.2024, which was again forwarded by the first respondent to the respondents 3 and 4 by proceedings dated 06.09.2024. The grievance of the petitioner is that despite the same, the third respondent has not conducted any enquiry and passed final orders. 5.
Considering the limited scope of the relief sought for, this Writ Petition is allowed with a direction to the third respondent to conclude the enquiry based on the petitioner's application dated 24.06.2024 and pass final orders, on merits and in accordance with law, after hearing the petitioner as well as the person, in whose name the patta has been presently mutated. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
