This Criminal Original Petition is filed seeking a direction to the learned Judicial Magistrate No.III , Thanjavur to take the cognizance under sections 3(1)(x) of Prevention of Scheduled Caste/Schedule Tribes Act 1989 and relevant Indian Penal Code against the remaining accused Kaliyaperumal, Siva Gnam, Senthil, Samanantham, Arumugam, Muruganantham, Samynathan, Amirthalingam, involved in the above occurrence upon considering the evidence adduced by the petitioner constitute the prima facie case against the above mentioned persons. 2.When the matter is taken up for hearing, the learned Government Advocate (Crl. Side), on instructions would submit that the complaint copy is not available with the respondent. 3.In view of the above submission, the petitioner is directed to give a fresh complaint within a period of one week from the date of receipt of a copy of this order. On such receipt, the respondent shall take action as per law. 4.With the above direction, this Criminal Original Petition is closed.
