ORDER

The petition has been filed for transfer of investigation in Crime No.622 of 2021 from the file of the fourth respondent to the file of the third respondent.

2.The learned Counsel appearing for the petitioner stated that the petitioner's son was murdered by the accused persons, nearly ten accused persons. Immediately, he lodged a complaint and on the said complaint, the fourth respondent registered the case in Crime No.622 of 2021 only as against three accused persons for the offences under Sections 450 and 302 of IPC. Though the petitioner specifically stated that the allegations as against other persons, the fourth respondent failed to register a case as against the other accused persons.

3.The learned Additional Public Prosecutor stated that after recording the confession statement of one of the accused persons, now they are about to implead the other accused persons. 4.In view of the above submission, at this stage if the investigation get transferred, it will affect the entire investigation. Therefore, this Court deem fit to direct the fourth respondent to complete the investigation and file the final report within a period of twelve weeks from the date of receipt of a copy of the order. The third respondent is also directed to monitor the investigation done by the fourth respondent and also monitor that the fourth respondent shall comply with the order passed by this Court.

5.With the above direction, this criminal original petition is disposed of. Consequently, the connected miscellaneous petition is also closed.
