2.The learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that due to property dispute between the brothers, complaint has been given by the defacto complainant to the police. He would further submit that petition enquiry is pending.

CRL OP(MD). No.3882 of 2020 3.At the time of admission of the anticipatory bail petition, this Court has passed an order restraining the respondent police not to arrest. If the petitioner participate in the enquiry they can proceed with investigation and file final report. 4.Based on the submission made by the learned Government Advocate (Crl Side), this Court disposed of this anticipatory bail application with the following directions:

(i)The petitioners herein shall appear before the investigating officer as and when required and cooperate with the enquiry. (ii)The respondent shall not take any coercive measures unless and until the investigation reveals cognizable offence against the petitioner.

Consequently, the connected criminal miscellaneous petition is closed.
