ORDER

This Writ Petition is filed seeking a Writ of Mandamus, directing the respondents to carry out the appropriate survey and demarcate the boundaries of the petitioner's lands situated in Survey Nos.209/12, 209/3, 209/8, 209/9, 239/15, 245/2, 256/15, 256/4, 256/8, 407/1, 408/7, 408/8B, 256/3 and 477/8 at Malampatti Village, Sivagangai Taluk, Sivagangai District, based on the petitioner's survey Application No.2026/0123/23/000255 and 2026/N123/23/000109, dated 22.01.2026 and subsequent representation dated 02.02.2026, within a stipulated time as fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the subject properties. The petitioner submitted applications dated 22.01.2026, requesting survey and fixation of the boundaries of the said

properties. Despite the same, the respondents have failed to take any action, causing undue delay and prejudice to the petitioner. The petitioner, therefore, seeks a direction to the respondents to conduct the survey and fix the boundaries, within a time frame to be fixed by this Court.

4. The learned Government Advocate appearing for the respondents would submit that proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

Recording the aforesaid submission, this Court directs the respondents to consider the petitioner's applications dated 22.01.2026 and demarcate the subject properties, after considering the claims of the petitioner, and any other rival parties, if any, and to pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of sixteen weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
