ORDER
The petitioner has participated in the written examination conducted by the respondent Medical Services Recruitment Board for the post of Health Inspector Grade-II. The petitioner, with a grievance that the marks has not been properly awarded, requested the respondents to provide his answer sheet, however, the same has not been considered by the respondents. Therefore, the petitioner has filed this writ petition seeking a writ of mandamus.
2. When this writ petition came up for admission on 17.02.2026, Mrs.P.Yasmin Begum, learned counsel, took notice for the respondents and submitted that the Medical Services Recruitment Board is engaging 2/6
the learned Additional Advocate General in this case and therefore, she requested for a short accommodation. Therefore, this writ petition is listed today.
3. The learned Additional Advocate General appearing for the respondents submits that the Notification does not prescribe the entitlement of answer sheet.
4. This Court considered the rival submissions made.
5. The petitioner has made a request to the respondents to provide his answer sheet. The reason for denial of the request of the petitioner is that there is no provision enabling the Medical Service Recruitment Board to provide the answer sheet. We are under the age of the Right to Information Act. The government, in order to have transparency in the administration, has enacted an act for providing the information under the Right to Information Act. Even as per this act, the answer sheet of the examination is not a prohibited thing and it can be furnished. The respondent Medical Services Recruitment Board shall ensure 3/6
transparency in administration by furnishing the answer sheet of the petitioner.
6. Therefore, this writ petition is allowed with a direction to the respondents to provide the answer sheet of the petitioner, within a period of four weeks from the date of receipt of a copy of this order.
