ORDER : The Court Made the following order :- The petitioner, who was arrested on 11.07.2017 for the offence punishable under Sections 406, 420 IPC in Crime No.05 of 2017 on the file of the respondent Police, seeks bail.
2.The case of the prosecution is that the petitioner herein is running Honey business and was received advance amount from the de facto complainant for supplying honey. But the petitioner has not supply honey to the de facto complainant. Hence, the present case has been registered.
3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is in judicial custody from 11.07.2017 onwards. 4.The learned Government Advocate (Crl.side) submitted that a sum of Rs.13,00,000/- is yet to be recovered from the accused. According to him investigation is still pending. 5.The submissions made by the learned counsels appearing on either side are considered. It is alleged that during the time of occurrence the de facto complainant, through bank transaction paid a https://hcservices.ecourts.gov.in/hcservices/
sum of Rs.96,66,000/- to the accused in order to purchase honey from them. After the above said transaction, the accused sent reply to the de facto complainant that only portion of the amount was received by them. As of now, according to the prosecution, a sum of Rs.13,00,000/- is yet to be recovered from the accused. Further more, the transaction was completed by way of bank transaction. Therefore, extensive investigation is necessary for completing the investigation. Thereby, custodial interrogation is very much necessary.
