FOR ANRICIPATORY BAIL IN CRIME NO.218/2023 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148 and 302 IPC in Crime No.218 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/4

2. The case of the prosecution is that the defacto complainant's husband, A1 and the petitioner were friends. There was some dispute between them. On 31.10.2023, at about 05.30 pm., the husband of the defacto complainant went near Thirukattupalli in his bike and he was murdered. Hence, the case.

3. The learned counsel appearing for the petitioners would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail.

4. The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner herein paid a sum of Rs.50,000/- to A8 through A3 to murder the deceased. That apart, the petitioner herein is having six previous cases. The custodial interrogation of the petitioner is very much required in this case. Therefore, he strongly objected to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials on records.

6. On perusal of records, it is noticed that the petitioner herein paid a sum of Rs.50,000/- to other accused to murder the defacto complainant's husband. As 2/4

rightly pointed out by the learned Additional Public Prosecutor appearing for the respondent, custodial interrogation of the petitioner is very much required.

7. It appears that this is the second application for anticipatory bail and the earlier anticipatory bail application filed by the petitioner in Crl.OP(MD)No.22830 of 2023 was dismissed by this Court on 20.12.2023, considering the gravity of offence committed by the petitioner. Now, this application is filed by the petitioner without referring the change of circumstances to consider the case.

Considering the above facts and circumstances of the case and also considering the fact that there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. 9.In the result, this Criminal Original Petition is dismissed. sd/- 26/02/2024 / TRUE COPY / /03/2024 Sub-Assistant Registrar ( C.S.
