Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 1st respondent to release the petitioner's vehicle of Lorry bearing Registration No.TN-65-AY-4978 and to hand over the above vehicle to the petitioner, by considering the petitioner's representation dated 22.04.2019, within the time limit that may be stipulated by this Court.

ORDER

Heard the learned counsel on either side. By consent of both parties this writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner's vehicle was seized by the police in connection with criminal case pertaining to illegal transportation of sand. A criminal case is pending against the petition mentioned vehicle. The respondent police is directed to produce the vehicle before the jurisdictional Magistrate forthwith and without any delay. The petitioner is permitted to move the jurisdictional Magistrate seeking release of the vehicle. The learned jurisdictional Magistrate shall entertain the petition and dispose of on merits and in accordance with law.
