Prayer:Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to issue possession Certificate (Tools and Plants, Vehicles, AnnexureC) so as to enable the petitioner to participate in the e-tender second call for the work NABARD RIDF XXIII (2017-18) Kottakudi to Vannamparaipatti scheduled to be held on 03.04.2018, based on his representation dated 23.03.2018 within a stipulated time. ORDER

According to the Petitioner, he is the Grade I contractor. He applied for e-tender called for by the respondents. The tender was cancelled on the ground that the petitioner has not submitted possession certificate, required for the tender as per Clause 7 of the said tender notification. Hence, he made a representation to the respondents for grant of possession certificate. Since, no order has been passed, the petitioner has filed the present writ petition.

2.In the above circumstances, since the petitioner's representation is dated 23.03.2018 and it is pending till date, without going into the merits of the case, the respondents are directed to consider the petitioner's representation, dated 23.03.2018, conduct enquiry after issuing notice to the petitioner and pass orders on merits and in accordance with law, on or before 23.04.2018.

3.With the above direction, this Writ Petition is disposed of. No costs.
