PRAYER :- For Bail in Crime No.30 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- This petition has been filed by the petitioner/ accused no.3 seeking bail for the alleged offence punishable under Sections 406 and 420 of IPC.
2. The case of the prosecution is that the petitioner herein along with four accused have made to believe the defacto complainant that they will arrange loan to the tune of Rs.1 crore and has cheated him after collecting around Rs. 11 lakhs. Hence the defacto complainant has approached the respondent police and gave a written complaint on 03.02.2020. Based on the complaint the petitioner and others were arrested .
3. A reading of the First Information Report indicates that this is not a mere case of arranging loan and cheating the defacto complainant. He has attempted to circulate fake currency and the defacto complainant himself has not come out with real fact in his complaint except part of which have been admitted by A1 and A2 in the confession statement.

4. The learned counsel for the petitioner would submit that the transaction took place on several dates. Even according to the prosecution except on 03.02.2020 the petitioner had never been in association of the other accused or to have played any role in the alleged transaction.
5. This fact has to be probed into and verified in the course of investigation. As of now, this Court finds that the gang which has identified as gullible persons have attempted to circulate fake currency in exchange of original currency. As of now the investigation is at very nascent stage, hence the petitioner cannot be granted bail for the present.
