The civil revision petition has been filed challenging the order passed by the Trial Court dismissing the application filed by the petitioner seeking temporary injunction restraining the respondents from interfering with his possession. An appeal against an order refusing temporary injunction lies before the Appellate Court under Order 43 Rule 1(r) of the Code of Civil Procedure. In view of the availability of the statutory appellate remedy, the 1/3

present civil revision petition is not maintainable. Hence, this Civil Revision Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
