PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying, to direct the Respondent No.2 not to interfere in the civil dispute of the Petitioner with the Respondent No.3.

O R D E R

The learned Counsel for the Petitioner submits that the Petitioner had purchased the property through registered sale deed bearing Doc.No. 294/2023 to an extent of 1.09 hectors at Mulaikaraipatti, Nagaunaeri, Thirumalpuram, Tirunelveli District. The third Respondent has no right or claim over the property. While so, he is attempting to remove the fence over the property. Therefore, the Petitioner was forced to file a suit in O.S.No. 200 of 2023 on the file of the learned Subordinate Judge, Nanguneari. After filing of the suit, the third Respondent lodged a complaint before the second Respondent claiming part of the land belong to him. 2.It is his further submission that the third Respondent had not furnished any documents or records to prove his claim. Still, the second Respondent had opened up CSR and summoned the Petitioner. Therefore, the Petitioner was forced to file this Petition seeking directions against the Respondents 1 and 2 not to harass him.

3.The learned Government Advocate (Crl.side), on instructions of the second Respondent, submits that the Petitioner had filed O.S.No.200 of 2023 on the file of the learned Subordinate Judge, Nanguneari. The third Respondent had filed a suit in O.S.No.124 of 2023 on the file of the very same Subordinate Judge. Based on the undertaking given by the third Respondent and the Petitioner herein, current paper was closed on 07.12.2024.

Recording the submission of the learned Government Advocate (Crl.side), this Petition is closed.
