ORDER

The petitioner has approached this Court that the order of this Court in WP.(MD)No.31721 of 2025 dated 07.11.2025, has not been complied with.

2.The petitioner is working as PG Assistant. He was not permitted to continue his service in Hindu Nadar Higher Secondary School, Kdambur and therefore, he has filed a writ petition in WP.(MD)No.31721 of 2025 seeking a direction to forbear respondents 6 & 8 in the writ petition from preventing the petitioner from discharging his duty as PG Assistant. This Court by its order dated 07.11.2025 has disposed the said writ petition with a direction to the third respondent to conduct enquiry on the complaint raised by the petitioner by issuing notice to the school and to take appropriate action, if it is found that the sixth respondent has not permitted the petitioner to enter into the school.

3.The petitioner with a grievance that even after order of this Court, the petitioner has not been permitted to discharge his duty by the School authorities, has filed this contempt petition. 4.The learned Additional Government Pleader appearing for the contemnor/third respondent, by referring to a proceedings dated 25.02.2026, submits that enquiry was conducted by the contemnor/third respondent, pursuant to the order of this Court dated 07.11.2025 and sixth respondent was directed to permit the petitioner to discharge his duty.

5.The learned counsel for the petitioner submits that despite this order, the School authorities have not permitted him to discharge his duty.

6.This Court has considered the submissions made on either side and perused the available materials in the record. 3/6

7.This Court has allowed the writ petition in WP.(MD)No. 31721 of 2025 with a direction to the contemnor/third respondent to conduct enquiry and issue necessary orders. It appears that the contemnor/third respondent has conducted enquiry and issued order. It is the responsibility of the contemnor/third respondent to ensure that the order has been complied with. In the event, if the sixth respondent school is not complying the order passed by the contemnor/third respondent, then necessary action has to be taken as against the sixth respondent school by the third respondent. Accordingly, this contempt petition is closed with a further direction to the contemnor/third respondent to ensure that the petitioner is inducted into school, within a reasonable time.
