ORDER : The Court Made the following order :- The petitioner / sole accused, who was arrested on 28.07.2017 for the offences punishable under Sections 8(c) r/w 20 (b) (ii) (B) of NDPS Act in Crime No.51 of 2017 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner is in possession of 5.100 kms of ganja in his two wheeler. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner has no necessity to commit any offence as alleged by the respondent Police and the said case is falsely foisted against the petitioner only for statistical purpose.

4.The learned Additional Public Prosecutor submitted that petitioner is the sole accused in this case and he has 3 similar type of previous cases under Sections 8(c) r/w 20 (b) (ii) (B) of NDPS Act in Crime Nos.6, 45 & 9 of 2016, on the file of the https://hcservices.ecourts.gov.in/hcservices/ respondent Police and investigation is still pending in this case.

5.Considering the facts and circumstances of the case and considering the fact that the petitioner has 3 similar type of previous cases under NDPS Act, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, this petition is dismissed.
