O R D E R
This Criminal Original Petition has been filed to call for the records pertaining to the First Information Report in Crime No.8 of 2023 on the file of the 1st respondent and to quash the same.
2. The case of the prosecution is that the marriage between the defacto complainant and the first accused was solemnized on 17.02.2016 as per Hindu rites and customs. At the time of marriage, the first accused was unemployed and disputes arose between them. After some time, the first accused went to Philippines for employment along with the defacto complainant, but the disputes continued even thereafter. Hence, the defacto complainant returned to India along with her child. When the petitioner tried to address the issues with the husband's family, things aggravated by the behaviour and words of the petitioners/accused, hence the present complaint came to be lodged.
3. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) appearing for the 1st respondent and the 2/6
learned Senior counsel appearing for the second respondent.
4. Further, the first petitioner is the husband of the defacto complainant, and petitioners 2 to 5 are her in-laws. This Court has already quashed the charge sheet in C.C.No.1478 of 2024 on the file of the Additional Mahila Court, Madurai, insofar as petitioners 2 to 5 are concerned. During the pendency of the present quash petition, this Court directed the parties to undergo counselling. It has been reported that prolonged counselling is required between the first petitioner and the defacto complainant. However, the first petitioner submitted that he is employed abroad and is unable to attend counselling proceedings. He has further stated that there is no possibility of reconciliation. On the other hand, the defacto complainant has expressed that there remains a possibility of reconciliation between the parties.
Considering the submissions and the status of counselling, this Court is not inclined to pursue reconciliation at this stage. In the meantime, the respondent/prosecution has filed the final report, which has been taken on file in C.C. No.1478 of 2024. Therefore, the first petitioner is required to face trial.

5. It is evident from the records that the defacto complainant filed Crl.O.P. (MD) No. 5707 of 2023 before this Court, and by order dated 28.03.2023, this Court directed the respondent to conduct further investigation and file a final report. In compliance with the said order, the respondents proceeded with the investigation and have since filed a final report before the concerned Magistrate. Therefore, the allegation of contempt made by the first petitioner is unfounded.
6. Accordingly, this Criminal Original Petition is dismissed in respect of the 1st petitioner. Consequently, connected miscellaneous petition is closed.
