Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the respondents to revise the pension and commuted value of pension payable to the petitioner based on G.O.Ms.No. 61 Transport Department dated 30.04.2015 and further directing the respondents to pay the difference amount in commutation and difference amount in pension together with arrears of pension with interest at 18% per annum payable from the date of his retirement to till the date on which the above monetary benefits are settled to the petitioner. 2. The petitioner is a retired employee of the Tamil Nadu State Transportation Corporation (Kumbakonam) Limited. He retired from service on 28.02.2011. Subsequent to his retirement, a settlement was entered into between the Management and the employees on retrospective basis. It is not in dispute that the petitioner is entitled to the benefits of the wage settlement. Since the difference amount was not paid, this writ petition came to be filed.
3. Today, when the matter was taken up for disposal, the learned Standing Counsel appearing for the respondents would submit that difference amount in respect of salary, leave salary and gratuity have already been settled. The pension amount has also been revised. What remains to be settled is the difference amount in respect of arrears of pension and commutation. The Management shall settle the same within a period of eight weeks from today.
4. This Writ petition is allowed as indicated above. No costs.
