PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records of the 1st respondent impugned communication in FCI/317365025/24 dated 14.03.2024 and quash the same as illegal and consequently direct the 1st respondent to issue passport to the petitioner's by considering his application No.TR1074919778322 dated 26.12.2022 and for other reliefs within a period stipulated by this Court.

ORDER

The present writ petition has been filed challenging the order of closure issued by the first respondent wherein the request of the petitioner for issuance of the passport was closed on the ground that the petitioner has not offered his explanation.

The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.65 of 2021, on the file of the second respondent which has culminated in filing of a charge sheet before the learned Judicial Magistrate, Thiruvidaimarudur on 25.08.2022. However, due to memo of objections raised by the said Court, so far, the charge sheet has not been taken on file.

In view of the fact that the criminal Court has not yet taken cognizance of the criminal case, there is no legal impediment for the first respondent to consider the request of the petitioner for issuance of the passport. Therefore, the petitioner is directed to file a fresh application seeking passport. In case if any such application is filed, the same shall be disposed of within a period of 4(four) weeks from the date of receipt of a copy of this order.
