ORDER : The Court Made the following order :- The petitioner is the sole accused and he was arrested and remanded to judicial custody on 14.02.2015 for the alleged offences punishable under sections 294(B), 324, 304(i) and 506(ii) of IPC, in Crime No.48 of 2015, on the file of the respondent police and hence, seeks bail.
2.The case of the prosecution is that on 12.02.2015 there was a wordy quarrel between the petitioner and the de-facto complainant, who were in inebriated mood and thereafter, the petitioner attacked the deceased with Aruval and subsequently, the deceased fell into a pond and died.
3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and the deceased himself fell into the pond and died. He further submitted that the petitioner has been in judicial custody for more than 52 days. 4.The learned Government Advocate (Criminal side) appearing for the respondent submitted that the petitioner is the sole accused and he only caused the death of the deceased and the major portion of https://hcservices.ecourts.gov.in/hcservices/ the investigation is over.
5.Considering the facts and circumstances of the case and also considering the fact that the petitioner is in jail since 14.02.2015 and also considering the overtact attributed against the petitioner, this Court is inclined to grant bail to the petitioner with certain conditions.
6.Accordingly, the petitioner is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Pudukkottai and on further condition that the petitioner shall report before the respondent police daily twice i.e., at 10.00 a.m. and 5.00 p.m. until further orders.
