PRAYER : FOR BAIL IN CRIME NO.28 OF 2024 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner, who was arrested on 10.02.2024 and remanded to judicial custody for the offences under Sections 109, 341, 342, 364, 302 and 201 IPC in Crime No.28 of 2024 on the file of the respondent police, seeks interim bail.

2. The learned counsel for the petitioner submitted that the petitioner's wife passed away today, ie., 21.02.2024 and the petitioner being the husband has to 1/3

perform the final rites. Hence, he prays for grant of interim bail.

3. The learned Additional Public Prosecutor appearing for the respondent, on instructions, submits that the wife of the petitioner passed away on 21.02.2024.

4. Considering the fact that the final rites of the petitioner's wife is to be held on 22.02.2024, this Court is inclined to grant Interim Bail to the petitioner. Accordingly, the accused Pugazhenthi, in Crime No.28 of 2024, is directed to be released on Interim Bail for a period of four days starting at 5.00 p.m. on 21.02.2024 till 5.00 p.m. on 24.02.2024 and the accused shall surrender before the respondent police at 5.00 p.m. on 24.02.2024 and he shall be produced before the trial court by the respondent police on the same day.

5. During the said period, ie., from 21.02.2024 to 24.02.2024, when the petitioner is on bail, he shall be escorted by a police constable and the expenses towards the same shall be borne by the petitioner.
