These impleading applications have been filed to implead one Mohammed Ibrahim claiming right under one sulthan Ibrahim, who is said to have been issued with settlement patta.

2.Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3.One Xavier, who is also similarly placed, filed a Writ Petition in W.P(MD)No.7129 of 2022 and the said Writ Petition was disposed of directing the official respondents therein to quantify the amount payable to the Petitioners as fixed in the year 2009. In the said Writ Petition, direction was given to pay the amount quantified by the official respondents with interest at the rate of 4% pa. On payment of the amount as directed, the Tahsildar is directed to issue patta in respect of the property in his possession in the very same survey number. 1/3

4.The impleading Petitioner challenged the said order and filed a Writ Appeal in W.A(MD)No.364 of 2024. The said Writ Appeal was dismissed by the Division Bench by relegating the Petitioner to establish his title before the civil Court. The impleading Petitioner who suffered an order in W.A(MD)No.364 of 2024 is not entitled to claim that he should be impleaded in the present proceedings between the Writ Petitioners and the Government. If the Petitioner has got any independent title over the property in question, the same shall be established by the Petitioner in a separate civil suit. Any order in these Writ Petitions will not affect the independent right of the Petitioner, if any. 5.Therefore these impleading petitions are dismissed. 28.07.2025 vsn 2/3
