Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to grant permission and necessary protection to conduct Pongal Festival and its allied events such as sport events for the children, Anna Dhanam, Temple Pooja, Cultural events etc., at Kaya Vembupathi Narayanaswami Kovil in Kayavembu Pathi, Rasthakadu, Variyoor Post, Kanyakumari District Scheduled to be held on 14.01.2018, 15.01.2018 and 16.01.2018.

[Order of the Court was made by M.SATHYANARAYANAN, J.] By consent, this writ petition itself, is taken up for final disposal.

2.Mr.C.M.Marichelliah Prabhu, learned Additional Government Pleader, accepts notice for the respondents.

3.The petitioner claims to be a Village Head and administer of the temple namely Kaya Vembupathi Narayanaswamy Temple, situated in Rasthakadu Village, in Kanyakumari District and came forward to file this writ petition as Public Interest Litigation praying for appropriate direction directing the respondents to grant permission to conduct Pongal Festival and allied events scheduled to be held from 14.01.2018 to 16.01.2018.

4. The learned Counsel appearing for the petitioner would submit that the representation, dated 23.12.2017 submitted in this regard is yet to be disposed of and hence, he came forward to file the present writ petition.

5. The learned Additional Government Pleader, on instructions, submitted that necessary permission has been accorded to conduct the said festival subject to the terms and conditions.

6. Since necessary permission has been accorded, the petitioner who claims to be the head and administer of the said temple, shall ensure that the said conditions are scrupulously complied with and in the event of any law and order problem, the respondents 1 and 2 are at liberty to take appropriate action in accordance with law, against the persons, who may be a cause for it.

7. The Writ Petition stands disposed of accordingly. No costs.
