O R D E R

This petition is filed by the petitioners for a direction to the second respondent herein not to harass the petitioners under the guise of enquiry, based on the false complaint.

2. The learned counsel appearing for the petitioners states that the first petitioner is the wife of Late M.Kannappan and the second petitioner is the son of Late M. kannappan. It is stated that the first petitioner's husband borrowed several amount from various third parties and that he also filed Insolvency Petition in I.P.No.94 of 2015, on the file of the III Additional Sub Court, Madurai. In the circumstances, the first petitioner's husband died on 03.06.2017. However, to get the money which was advanced to the first petitioner's husband, the individuals who lent money to the petitioner's husband have given a false complaint as against the petitioners to extract money from them. In the circumstances, it is alleged that the petitioners are being harassed by the respondent police under the guise of enquiry. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Government Advocate (Criminal Side) on instructions, however, submitted that no complaint was received as against the petitioners by any one and that therefore, there is no harassment and there is no enquiry so far.

4. Recording the submission of the learned Government Advocate (Criminal Side), the Criminal Original Petition is closed. However, in this case, if the petitioners appearance is required for any enquiry, it shall be done only after issuing summons prescribing date and time and in the manner prescribed in law.
