O R D E R
This Criminal Original petition is filed seeking a direction to the respondent not to harass the petitioner and his family members under the guise of enquiry.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal side) appearing for the respondent.
3. It is stated that the respondent police without any valid reason came to the petitioner's house on 20.07.2017 and asked the petitioner to come to police station. Without disclosing any complaint as against the petitioner, the petitioner is called upon to attend an enquiry and the petitioner is being harassed under the guise of enquiry.
4. The learned Government Advocate(Criminal Side) however on instructions submitted that one Rasheed Ali has given a complaint about some fraudulent activities in connection with huge forgery. It is further submitted that the petitioner was called upon to attend the enquiry in connection with the said forgery case involving several individuals.
5. It is open to the respondent police to hold an enquiry and such enquiry should actually be done only in accordance with law and the direction of this Court as well as the Hon'ble Supreme Court should be scrupulously followed when the enquiry is conducted, alleging anyone for commission of any offence. Even if the presence of the petitioner is required for any enquiry, the same shall be https://hcservices.ecourts.gov.in/hcservices/
done only after issuing summons prescribing date and time and in the manner known to law.
6. With the above observation, the Criminal Original petition is closed.
