This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to issue patta in the name of the petitioner in respect of the petitioner's property comprised in Survey No. 15/1A1A, Kondapethaan Village, Madurai East Taluk, Madurai District, after conducting survey and demarcating the property, in adherence to the order of this Court dated 17.11.2021 made in W.P.(MD) No.20492 of 2021, within the time stipulated by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The grievance of the petitioner is that he is the absolute owner of the subject property. Though the petitioner has made several attempts Page No. 2 of 5
seeking survey and demarcation of the property and issuance of patta in his name, no effective steps have been taken by the respondents despite the order of this Court dated 17.11.2021 made in W.P.(MD) No.20492 of 2021 filed by the petitioner. The petitioner now submitted representations dated 08.11.2025 seeking survey and 22.01.2026 seeking issuance of patta. Even thereafter, no orders have been passed. Therefore, the petitioner has been constrained to file the present Writ Petition.
4. The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that the petitioner's representations dated 08.11.2025 and 22.01.2026 would be considered and appropriate orders would be passed within a period of twelve weeks.
5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the respondents to consider the petitioner's representations dated 08.11.2025 and 22.01.2026 and pass appropriate orders on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The representations shall be disposed of after conducting an enquiry. The respondents are also directed to provide Page No. 3 of 5
a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to work out their remedies before the competent Civil Court. There shall be no order as to costs.
