PRAYER :- for Anticipatory Bail in petition Nos.DSB/DCB/711/2019 and DSB/DCB/859/2019 of 2019 on the file of the respondent police. ORDER : The Court made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the offences punishable under section 420 of IPC, in Crime No.Not Known of 2020, on the file of the respondent police, seek anticipatory bail.

2.The learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that the petitioners promising job in foreign country and cheated several persons. Based on the complaint, the respondent police has registered a petition in Current paper Nos.DSB/DCB/711/2019 and DSB/DCB/859/2019. After filing these petitions, petitioners are not cooperated with the enquiry, since the court has restrained the respondent from https://hcservices.ecourts.gov.in/hcservices/ 1/2

arresting them. He would further submit that if the petitioners cooperate with the investigation, the respondent should be in possession find out truth in the petition.

3.This Court is of the considered view, there is no necessity to grant anticipatory. However, if the petitioner cooperate with the investigation, the respondent police shall not take any coercive measures. On completion of the investigation, if there is any cognizable offences committed by the petitioners, they can proceed against the petitioners in accordance with law. It there is noncooperation on the part of the petitioner, the respondent can take coercive measures.

4.With the above direction, these criminal original petitions are disposed of.
