For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PRAYER :- for Anticipatory Bail in petition No.DSB/DCB/112/2020 of 2019 on the file of the respondent police ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under section 420 of IPC, in Crime No.Not Known of 2020, on the file of the respondent police, seek anticipatory bail.
2.The learned Government Advocate (Crl. Side) appearing for the respondent Police would submit that based on the complaint given by one Panis Aswini Jenibha alleging that the petitioner cheated to the tune of Rs.26,600/- from the defacto complainant, the respondent police has registered a petition in Current paper No.DSB/DCB/112/2019. After filing these petitions, petitioners are not cooperating with the enquiry, since the court has restrained the respondent from arresting them. CRL OP(MD). No.3909 of 2020 3.This Court is of the considered view that there is no necessity to grant anticipatory. However, if the petitioner cooperate with the investigation, the respondent police shall not take any coercive measures. On completion of the investigation, if there is any cognizable offences committed by the petitioner, they can proceed against the petitioner in accordance with law. It there is any non cooperation on the part of the petitioner, the respondent can take coercive measures.
4.With the above direction, the criminal original petition is disposed of.
