RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to condone the absence due to the health problem on 16/02/2022 and 17/02/2022 before the Learned Sessions Judge Special Court for POCSO Act Cases, Tirunelveli in complaince with direction issued by this Honble Court in Crl.OP(MD)No.20365 of 2021 dated 23/12/2021 in Cime No. 5 of 2019.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.G.ANTO PRINCE, Advocate for the petitioner and of MR.R.SIVAKUMAR, Government Advocate (Crimal Side) on behalf of the Respondent, the court made the following order:- This petition has been filed to condone the absence due to the health problem, on 16.02.2022 and 17.02.2022 before the learned Sessions Judge, Special Court for POCSO Act Case, Tirunelveli, while complying with direction issued by this Court in Crl.OP(MD)No.20365 of 2021.

2.The learned counsel for the petitioner would submit that the petitioner has granted bail by this Court vide order dated on 23.12.2021 with condition that he shall appear before the concerned Magistrate daily at 10.30 am until further orders. He would further submit that the petitioner has complied with the conditions regularly and due to health issue, he could not appear on 16.02.2022 and 17.02.2022 before the learned Sessions Judge, Special Court for POCSO Act Case, Tirunelveli and hence, his absence may be condoned. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD) No.3236 of 2022 3.Being satisfied with the reasons stated in the affidavit filed in support of the petition, the absence of the petitioner before the learned Sessions Judge, Special Court for POCSO Act Cases, Tirunelveli, is condoned.

4.The petition is ordered accordingly.
