O R D E R

This writ petition has been filed seeking a direction to forbear respondent Nos.2 to 5 from appointing the sixth respondent as a nonhereditary trustee of Arulmigu Kamatchiamman Udanurai Arulmigu Egambareswarar Temple, situated at Pagalavadi Village, Thuraiyur Taluk, Tiruchirappalli District, based on the petitioner's representation dated 22.12.2025.

2. The learned counsel appearing for the petitioner would submit that respondent Nos.2 to 5 have appointed the sixth respondent as a nonhereditary trustee of the subject temple, after the temple was brought under the control of the HR & CE Department on 02.05.2025.

The learned Special Government Pleader appearing for respondent Nos.1 to 5 would submit that the sixth respondent had earlier filed a writ petition before this Court in W.P.(MD).No.24141 of 2025 and this Court, by order dated 04.09.2025, directed the official respondents to constitute a Trust Board by including the sixth respondent herein. In compliance with the said order, the official respondents have taken steps to include the sixth respondent. Unless and until the said order dated 04.09.2025 is set aside or modified in the manner known to law, the respondents are bound to comply with the same and are not in a position to consider the petitioner's request.

4. I find force in the submissions made by the learned Special Government Pleader appearing for respondent Nos.1 to 5. When this Court in W.P.(MD).No.24141 of 2025, has specifically directed the 3/6

official respondents to constitute the Trust Board by including the sixth respondent, the respondents are bound to act in accordance with the said order. Unless the said order is challenged and set aside by a competent Court, the prayer sought for in the present writ petition cannot be granted.

If the petitioner is aggrieved by the order dated 04.09.2025 passed in W.P.(MD).No.24141 of 2025, it is open to the petitioner to challenge the same in the manner known to law, even as a third party, if so advised. In the absence of any such challenge, this Court is not inclined to entertain the present writ petition.
