Prayer : Civil Miscellaneous Petition is filed seeking permission to get ourselves S.Senthilkumar and S.Satheeshkumar proposed as 3 and 4 Appellants in A.S.(MD)No.174 of 2013 as the legal heirs of deceased 2nd Appellant/S.Pushpam.

ORDER

This Civil Miscellaneous Petition has been filed to bring on record the proposed 3rd and 4th petitioners as the legal heirs of the deceased 2nd appellant, namely S.Pushpam, and rank them as appellant Nos.3 and 4 in the Appeal Suit in A.S.(MD)No.174 of 2013 on the file of this Court.

2. Heard the learned counsel appearing on either side and perused the affidavit filed in support of this petition.

3. The learned counsel for the petitioners submitted that, during the pendency of the appeal suit, the 2nd appellant died and that the proposed 3rd and 4th petitioners are the legal heirs of the deceased 2nd appellant. He further submitted that he has also filed a copy of the death certificate of the 2nd appellant and copies of the Aadhaar cards of the proposed parties. 3/5

4. The learned counsel for the 9th respondent and the learned counsel for the 12th respondent have not raised any objection to allow this petition.

5. Being satisfied with the reasons stated in the affidavit, this Civil Miscellaneous Petition is allowed.
