PRAYER: Writ Petition filed under Article 226 of the constitution of India, to issue a writ of Mandamus, forbearing the respondents 1 to 3 from interfering with the petitioner's peaceful possession and enjoyment of S.F.No.105/2A-1A of Keeramangalam Village, Alangudi Taluk, Pudukkottai District.

ORDER

Mr.R.Murugan, Learned Additional Government Pleader, on instructions, states that the Petitioner has filed a suit in O.S.No.78 of 2013 before the Sub Court, Pudukkottai seeking the same relief that has been claimed in the Writ Petition. In that backdrop, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition and he has also made an endorsement to that effect, which is recorded.

Accordingly, the Writ Petition is dismissed as withdrawn. It is needless to add here that no view has been expressed by this Court on the merits of the correctness or entitlement of the claim made by the Petitioner and the Civil Court shall adjudicate the same on the basis of evidence adduced by the parties on merits and in accordance with law. No costs.
