ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 03.02.2026 for the offences punishable under Sections 296(b), 109(1), 309(4), 126(2) and 351(3) of the Bharatiya Nyaya Sanhita, 2023 and Section 25(1A) of the Arms Act and Section 3(1) of the TNPPDL Act, in Crime No.104 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner, along with other accused, wrongfully waylaid the defacto complainant, abused him in filthy language, attempted to murder him, demanded money and threatened him with deadly weapons, and also damaged the door of his house. Hence, the present case has been registered for the aforesaid offences.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner has been in incarceration from 03.02.2026 onwards. He further submitted that, due to the number of cases pending against the petitioner, 2/5
the respondent police have falsely foisted the present case against him. Hence, he prayed for grant of bail to the petitioner.
4. The learned Additional Public Prosecutor submitted that the petitioner has more than 15 previous cases against him, including cases under Sections 302 and 392 of IPC, as well as cases under the NDPS Act. Hence, he objected to the grant of bail to the petitioner.
5. This Court heard the learned counsel appearing on either side and perused the materials placed on record.
6. Considering the facts and circumstances of the case and also taking into account the previous antecedents against the petitioner, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, this Criminal Original Petition is dismissed with liberty to the petitioner to file a fresh bail petition after the examination of the material witnesses in the pending previous cases. 06.03.2026 pal 3/5
