PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to remove the petitioner's name from the History Sheet opened in History Sheet No.35 of 2020 on the file of the fourth respondent by considering the petitioner's representation dated 03.01.2025.

O R D E R

This petition has been filed by the petitioner to remove the petitioner's name from the History Sheet in H.S. No.35 of 2020, on the file of the fourth respondent police by considering the petitioner's representation, dated 03.01.2025.

2. Mr.R.M.Anbunithi, learned Additional Public Prosecutor takes notice for the respondents.

3. The learned counsel for the petitioner would submit that the petitioner is a driver and engaging a business to provide tipper lorry and JCB for rent. A case has been registered as against the petitioner in Crime Page No. 2 of 6

No.160 of 2019, on the file of the fifth respondent police, in which the petitioner has been falsely implicated as accused No.4. Thereafter, the fourth respondent police had opened a History sheet in H.S. No.35 of 2020 as against the petitioner. Already, the petitioner has sent a representation to the respondents, on 03.01.2025 to remove the name of the petitioner from the history sheet. But, the same has not been considered. Hence, he filed this petition.

4. The learned Additional Public Prosecutor appearing for the respondents would submit that they received the representation of the petitioner and the same is under consideration. After conducting enquiry, they will dispose of the representation of the petitioner, dated 03.01.2025 within a period of 15 days.

5. This Court heard both sides and perused the records.

6. Considering the limited scope of the prayer sought for in this petition, this Court is inclined to dispose of this petition at the time of admission itself.

7. Recording the submissions of the learned Additional Public Prosecutor, this Court directs the second and fourth respondents police to consider the representation of the petitioner and dispose of the same within a period of 15 from the date of this order.

8. With the above direction, this Writ Petition is disposed of. No costs.
