ORDER

This Criminal Original Petition has been filed to direct the respondent not to harass the petitioners under the guise of enquiry, frequently without any case.

2.The first petitioner states that his wife one Mrs.Sumathi, asked him to leave the matrimonial home and insisted him to live a separate life. The first petitioner further states that he is working as a Sweeper and his wife's native district is Theni. It is further submitted that the first petitioner's wife preferred a complaint before the respondent police and that under the guise of enquiry, the petitioners are being harassed.

that the he was harassing her demanding a sum of Rs.1,00,000/- from her parents. He further submitted that it was only in connection with the said complaint, an enquiry was conducted. The learned Government Advocate, ensured that there will not be any harassment.

4.It is made clear that the petitioners need not be harassed by the respondent police. Even if the complaint received discloses a cognizable offence, it is open to the respondent police to register the same and to deal with the same in accordance with law. If the appearance of the petitioner is required, the same shall be done only after issuing summons by prescribing the date and time and in the manner known to law. With these observations, the above Criminal Original Petition is closed.
