The writ petition has been filed seeking for a direction to the respondent to issue passport, based on the petitioner's application, dated 16.11.2017.

2. According to the petitioner, he has applied for the passport to the respondent on 16.11.2017 and the application is so far not considered on the ground that a criminal case is pending against the petitioner in C.C.No.21 of 2013 before the Special Court, Madurai. In the above circumstances, the present writ petition has been filed.

3. Admittedly, when a criminal case is pending, the petitioner is not entitled to the passport, in view of the bar under Section 6 (2)(f) of the Passport Act. If at all the petitioner wants to travel abroad, he has to approach the concerned trial Court and file an application seeking permission to travel abroad and if any permission is granted by the trial Court, then it is open to the https://hcservices.ecourts.gov.in/hcservices/

petitioner to apply before the Passport authority. In such circumstances, the relief sought for by the petitioner cannot be granted. Accordingly, the writ petition stands dismissed. No costs.
